Legal policies and compliance rules for using the Society99 SaaS platform

1. Introduction

These Terms and Conditions govern your access to and use of the **Society99** SaaS platform (the "Platform"). By registering a housing society, creating an administrative account, or logging in as a resident, you signify your absolute agreement to these Terms of Service. If you do not agree, please discontinue using the platform immediately.


2. Information Technology Act, 2000 Compliance

Society99 is fully compliant with the provisions of the **Indian Information Technology Act, 2000 (IT Act, 2000)** and subsequent amendments:

  • Data Protection (Section 43A): We implement reasonable security practices and procedures (RSPP) to protect sensitive personal data or information (SPDI) of housing society residents from unauthorized access, alteration, or disclosure.
  • Privacy & Disclosure (Section 72A): No personal information, mobile numbers, or billing details entered on the platform shall be disclosed to any third party for commercial gains without the explicit consent of the respective resident or administrator.
  • User Responsibility: Users are solely responsible for the authenticity of the ledger entries, payment receipt details, and complaints registered on the portal. Entering fraudulent bills or credentials violates platform policies and IT Act provisions.

3. Billing Surcharges & 18% GST

The platform operates on a software-as-a-service subscription pricing model:

Tax & Subscription Rates Notice:
  • The annual subscription fee is **₹99 per house / flat per year** (equivalent to ₹8.25 per month).
  • Pursuant to tax regulations, a **surcharge of 18% GST (Goods and Services Tax)** is charged extra on all platform invoices.
  • All subscription payments made to the platform are non-refundable.

4. Dispute Resolution & Legal Jurisdiction

In the event of any disputes, claims, or disagreements arising out of or relating to the platform services:

  • Amicable Settlement: Parties shall first endeavor to settle the dispute through mutual negotiation, mediation, or technical arbitration.
  • Exclusive Legal Jurisdiction: If a settlement cannot be reached, all legal actions, suits, or arbitral proceedings shall be subject to the exclusive jurisdiction of the competent courts located in **Noida / New Delhi, India**.

5. Changes to Terms

Society99 reserves the right to modify these terms and conditions at any time. Updated terms will be published on this URL and will take effect immediately upon posting.
